APPLICANT REQUESTS THAT: 

 

His Promotion Recommendation Form (PRF) for the Calendar Year 
2009C (CY09C) Major (Maj) Central Selection Board (CSB) be 
Reconsidered for “Definite Promote (DP).”

STATEMENT OF FACTS: 

 

A similar appeal was considered and denied by the Board on 
14 Jul 11. For an accounting of the facts and circumstances 
surrounding the applicant’s request, and the rationale for the 
earlier decision by the Board, see the Record of Proceedings, 
with Exhibits, at Exhibit M. 

 

By DD Form 149, dated 30 Jan 12, the applicant requests his PRF 
for the CY09C (CSB) receive reconsideration for a “DP.” 

 

In support of his appeal, applicant provides copies of his 
Officer Preselection Brief, Promotion Recommendation Forms, 
Officer Performance Report, and documents extracted from his 
military personnel records related to his matter.

THE BOARD CONCLUDES THAT: 

 

1. After careful consideration of the applicant’s 
reconsideration request and the documentation he submitted, we do 
not find the evidence presented is sufficient to override the 
Board's original decision. Although the applicant believes his 
opportunity for receiving a DP was impacted due to the issues 
with his security clearance, after a thorough review of the 
applicant’s latest submission, we do not find the documentation 
presented and the applicant’s assertions sufficient to conclude 
that his PRF is an inaccurate representation of the his promotion 
potential or that it was not rendered in good faith based on the 
information available at the time. Therefore, in the absence of 


evidence to the contrary, we find no basis to recommend granting 
the relief sought in this application. 

 

2. The applicant's case is adequately documented and it has not 
been shown that a personal appearance with or without counsel 
will materially add to our understanding of the issue(s) 
involved. Therefore, the request for a hearing is not favorably 
considered.

THE BOARD DETERMINES THAT: 

 

The applicant be notified the evidence presented did not 
demonstrate the existence of material error or injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of 
newly discovered relevant evidence not considered with this 
application.
